View Full Version : Oh ****!
Okay, it's a long story. I'll make it brief:
Clean license. 5 years no accidents, points, pulls etc.
This morning, pulled on M40 by car following for long time...
They had 114.5mph average speed reading (I was a bit relieved by that..)
They made no comment about my riding (I was riding at my best,
doing all my checks, indicating, shoulder checks etc. and adjusting
my high speed for changing traffic configurations and even using
the three lanes correctly, which is not always the case.)
They seemed a little sorry for me and explained they couldn't
realy ignore this.
So do you have any idea what I'll get for this? How big are the fines?
How long the bans? (I no longer need my bike for work..) Am I likely
to lose my license rather than just a ban?
Or just points? Lots of 'em..
Will I have to go to court!?
Well, I hope some of you can help me with this.
But it's not over....
<takes deep breath>
Coming into Oxford at my journeys end...I got pulled by
a frigging bike cop at the bottom of a steep clear hill!!!
He said the camera had me at 37mph in the 30, said I should
be setting an example, and let me go.
(This means I'm now really screwed, right?)
I don't fecking believe it!!!!!!

Well now, that's down to you - if a car is keeping pace with you you
should be aware of it and either vary pace to check, **** off before
they get your plate or more probably, drop it to approaching the limit
and wait for the pull - "a long time" ... oh, dear.

Relieved? ****. That's ban territory, that is - three months
minimum, prolly six IWT.

I'm not surprised they couldn't ignore it. Always aim to be the
*second*-fastest vehicle on the road ...

Lose licence/ban - that's the same thing, right? If you have had your
licence for less than two years you'll have to retake your test once
you've served out your ban, I believe.
>
>Or just points? Lots of 'em..
Naah. Ban and no points, I reckon: which may actually work out better
in the long term, funnily enough - at least you won't be carrying
round a shedload of points for three years.
>
>Will I have to go to court!?
Aye. Take your licence and a big tub of lube.

I'd say so. Did the bike cop say that a prosecution would follow?
>ThunderCat (for sale?)
That sounds wise. Go to court, fess up, look contrite and say you've
sold the hellish machine that led you astray and hope they don't put
you in Block D with Big Bernie.

Same thing isn't it? You can't drive/ride, that's for sure.
> Or just points? Lots of 'em..
I got six points for doing over the ton on a motorway. I had six points
already and led to a 6 month disqual.
> Will I have to go to court!?
If they are considering a ban, yes.
Did they caution you, you know, "you have the right to remain silent"
and all that? If they did then they've got 6 months to get the NIP to
you.

Er - the "losing your license" and "being banned" are synonymous.

This would only happen if you could demonstrate that you would suffer
severe and unreasonable hardship if you were banned (i.e. you'd lose
your job).
>Will I have to go to court!?
Yes
There's a chance the beak might want to throw more than 28 days at
you, so it's worth getting a brief in, if you can afford it (mine cost
about 150 quid and it was worth every ****ing penny).

He let you go, it's a different copper, so it has no impact at all.
With luck it'll come to court soon, and you'll have your ban served
before spring is properly started.

you're going to get a ban (this is the same as losing your licence).
Probably just a ban and a fine, and no points.
I'd get a solicitor to help you minimise the length of the ban/size of
the fine.
I'd also sell the bike, and tell them in court that you've done so.

Are they?
I interpreted "losing your licence" as a permanent thing requiring a retest
rather "than just a ban" which would be a temporary suspension of the
licence. The OP seems resigned to a ban and is asking if the court will
require a retest.
Pip answered this question with reference to the 2 year probation period
for new riders. This would be a mandatory requirement to take a new test.
IIRC a magistrate has the *option* to insist a new test is passed in many
more circumstances.

I reckon it'll be worse than that - average speed of 115? 65% over the

I think the automatic retest is only required if you have two
convictions within the first two years. Not that this starts from
passing a test, whether it be car or bike, and is not separated for
each, i.e. if you've had a car licence for years then pass the bike
test, you don't need to worry about it.
As for a court-imposed retest, well yes, this _can_ be ordered, but is
not commonly used for speeding offences. A careless/reckless charge
might tempt a court to order this; dangerous makes it much more
likely, and it's automatic for some more severe offences and/or if
you're banned for longer than a certain period (five years, I
believe).

I've never heard the phrase "lose your license" used to mean that a
re-test is required. IME, that's always explicitly stated e.g.
"banned for driving for two years with a mandatory re-test".

The 2 year thing? I think the idea is that, if you "get into good
habits" and keep to speed limits for fear of being retested, you'll be a
good little citizen all your life.

Worse in what way? IME, if you're banned for speeding, the
variability is in the length of the bad and the size of the fine.

If you're ordered to sit a re-test, I *think* you have to re-sit *all*
your tests. This can be a right bugger if you've got a car entitlement
as well or, dear God, car and HGV or PSV. A simple ban is a simple ban,

Indeed. When I got banned (admittedly a long time ago) for my first
offence, it was a simple ban and no pnts, leaving me free to start
racking them up. The only awkward thing was having to explain to
insurance companies how I managed to get a ban for a simple SP30
without totting-up, but as they took the court code and not the
punishment when assessing premiums, it made no difference (inscos
ignore one and sometimes even two speeding offences, as you know).

Well, as you say, you have to start from a blank sheet, including
theory(s), CBT and all required tests for all classes you had before.
Oddly enough, though, once you've redone said tests, the 'date passed'
is still the original, not the retest, date.
And yes, in this case, I am SWK.

Because, it seems to me, that people caught doing over the ton (and in this
case it's a fair bit over) are usually viewed in a very dim light.
Why I don't know considering doing 60mph in a 30mph is overall,I would
think, more likely to result in a mishap, but anyway.

Yes, but how could it be worse than a ban and a fine?

ATM my driving is almost all city-centre stuff, so I'm fairly safe as I
don't participate in the local Leeds sport of jumping red lights, but
those few times I have managed to get out for longer runs I'm going far
faster than is good for one's license ... last time out did Leeds -
Nigel's place in 2 hours, and South Wales - Leeds in 2 hours 28 mins,
which is basically doing 110-120 all the way, apart from a couple of
roadwork stretches ... this is plainly stupid in a car, as you can't
pull the "right, I'm ****ing off now" litrebike trick.

What with me being an ill educated lout I don't normally do literary

You seem to have absolutely no capacity for logical reasoning. Are
you sure you're not a girl?
1. I said "He'll get x"
2. You said "I think it'll be worse"
3. I said "Worse in what way"
4. You said "because something or other"
Do you see the disconnect between 3 and 4?
So, I repeat, "In what way do you think the punishment will be worse"
>Why I don't know considering doing 60mph in a 30mph is overall,I would

That wasn't for speeding <spells it out> that was for dangerous
driving.
Note the the case in Scotland posted the other day (and in MCN today),
where an off-duty copper doing 136 got 12 month ban & 500 quid, where
biker doing 145 got 2 year bad and £5000 grand - the reason the biker
got the book thrown at him was because he pleaded guilty to dangerous
driving.

It really is a luck of the draw thing.
By simple happenstance, since the nation has become obsessed with speed
I have been riding bikes that are capable (to varying degrees) of
exceeding the ton and am want to ride them as fast as I ****ing can as
often as I ****ing can. At the same time the bikes have all been nekkid
and riding much over 90 is ****ing hard work on a nekkid bike. So, for
comfort's sake alone, I tend to max out at about 80/85 except for the
odd burst. I get away with it.
I suspect that if I had a faired bike I would by now be a member of the
larger set of idiots.

My weakness is slip roads. I tend to do 85-90 on the motorway but on the
way there I usually cane it with everything it's got and can easily be
doing 150 plus when I get there.
That's how I got caught last time, albeit at an estimated 100mph.

Having a faired bike certainly makes going fast a lot easier.

I was always under the impression that 30mph+ over any mandatory speed
limit resulted in a ban.
Then again it's a long time since I studied the highway code etc. It's
over 11 years since I was instructing too, so things have probably
changed.

Dunno, I did Juliet and Romeo and the Merchant of Menace. I had a part

No. I believe the ACPO guidelines are that anything over 30mph has to
go to court. Certainly, I didn't get banned for doing 70 in a 30.

None of this is in the Highway Code, either.

That'd be the clincher for me. If _any_ car is either catching up

What paperwork did they give you at the time? I only ask as when SWMBO got
pulled for 130 they told her that they 'couldn't ignore' what she'd done
but, as she wasn't putting anyone in danger etc etc etc, they just gave her
an SP30 with 3 points/£60 FPN... Then again she's a burd and it was 6am on
an empty dual carriageway. I don't think I'd have got away as lightly.

On a Saturday afternoon in 1996 I was racing another Guzzi along the A27;
we were clocked (radar gun) at 115.
"Not dangerous but taking the piss" was the comment. FPN and a lecture
covering safety, the need to tax bikes and how great Guzzis are.

If Henry V didn't have parts, where did Henry VI come from?

Wasn't it some archer at Rouen, or summat?
Which is why Richard III had the right heebie-jeebies about not being
king.
So he killed his nephews, and walked with a hump.

Oh yess - and on nightime main route runs you can end up playing leap
frog with the same vehicle for miles and miles - unless you are on an
otherwise empty M5 at 8pm in November and the car - the only other
car in sight - which you slow down for turns out to be a civilian so
you **** off, only to find, as you pull in to the services for a
jimmy that it has transmogrified into a polis rover :(

They didn't comment on my riding, except to say I should look
in my mirrors more... They too said that whilst they have some
leeway (sp?), they couldn't ignore that speed.
They said it's possible to be banned for that rather than points.
He read me my rights and then waxed lyrical about how people
don't like to be without a license and maybe need one for work,
but then pointed out that a ban can be better 'cos you don't end
up carrying lots of points around for ages!
He then gave me a producer to check mot and insurance, and gave me
helpfull hints about how to take off from a slippy hard shoulder, and
off he went...
SP30 for 130? In a 30?? Which year was this?

<sigh> Not that question, which was obviously rhetorical. This one:
"Worse in what way?"

Hint: the "30" in "SP30" has nothing to do with the speed.

I sort of did answer it when I said lack of comprehension.
I had misunderstood was being meant - ie there are two punishments - fine
and points.
